Filing a Social Security Disability claim and can’t make heads or tails of what you need to do?

It can be frustrating applying to get your disability benefits. Understanding the Social Security’s rules and regulations can be impossible. Dealing with the Social Security Administration (SSA), and the government in general, can try your patience for sure.

The Social Security Administration considers you disabled under Social Security rules if you meet the following qualifications:

  1. You cannot do work that you did before
  2. The Social Security Administration decides that you cannot adjust to other work because of your medical condition(s)
  3. Your disability has lasted or is expected to last for at least one year or to result in death

Before the Social Security Administration  gets to that point of determining your disability, they look at the number of work credits you have.  If you have enough work credits, then you may be eligible to receive benefits.

The work credits are based upon your age when you became disabled. Forty work credits are needed and twenty of them have to be earned in the ten years before your disability.

Once the Social Security Administration determines you have enough work credits to qualify for disability, they use a five step process to determine if you are disabled. Here are the five steps

  1. Are you working
  2. Is your condition severe?
  3. Is your condition found in the list of disabling conditions?
  4. Can you do the work you previously did?
  5. Can you do other types of work?

Most claims are denied at the initial level because people don’t properly fill out their applications or send in the requested evidence for their case.
